  • Directly from you when you contact us, submit an enquiry, attend a meeting or otherwise communicate with us
  • From organisations that provide business-to-business contact and marketing data
  • From publicly available business information, including company websites, business directories and other legitimate public sources
  • Through professional networking and business development activity
  • From clients, suppliers, partners or other organisations where there is a lawful reason for them to provide the information to us

Where we obtain personal information from another source, we take reasonable steps to ensure that its use is lawful, fair and transparent.

Where appropriate, we also screen telephone marketing data against relevant preference services, including the Telephone Preference Service (TPS) and Corporate Telephone Preference Service (CTPS).

4. How We Use Personal Information

We may use personal information to:

  • Respond to enquiries and arrange consultations
  • Provide and administer our services
  • Communicate with clients and prospective clients
  • Identify businesses and individuals who may have a legitimate potential interest in our services or those we are engaged to promote
  • Undertake appropriate business-to-business sales and marketing activity

We do not sell personal information to third parties.

5. Our Lawful Bases for Processing

UK data protection law requires us to have a lawful basis for processing personal information.

Depending upon the circumstances, we may rely upon:

Legitimate interests

We may process business contact information where this is necessary for our legitimate interests, or those of our clients, in:

  • Developing and operating our business
  • Identifying and communicating with potential business customers
  • Undertaking proportionate business-to-business sales and marketing
  • Managing client and prospect relationships
  • Maintaining accurate business records
  • Protecting and improving our business and services

Before relying upon legitimate interests, we consider whether the processing is necessary and whether the individual’s rights and interests override those interests.

We take particular care where personal information relates to an identifiable individual rather than solely to a corporate entity.

Individuals have the right to object at any time to the use of their personal information for direct marketing.

Contract

We may process personal information where necessary to enter into or perform a contract with you.

Legal obligation

We may process information where necessary to comply with legal, regulatory, accounting or taxation requirements.

Consent

Where we specifically rely upon consent, you may withdraw that consent at any time.

Withdrawal of consent does not affect processing that was lawful before consent was withdrawn.

6. Direct Marketing and Business Development

Markalation undertakes business-to-business sales and marketing activities.

This may include contacting individuals in their professional capacity by telephone, email or other appropriate business communication channels.

We take reasonable steps to ensure that our marketing activities comply with applicable data protection and electronic communications legislation, including the UK GDPR, Data Protection Act 2018 and Privacy and Electronic Communications Regulations (PECR).

Where required, telephone numbers are screened against relevant preference services before marketing calls are made.

If you tell us that you do not wish to receive direct marketing from us, we will respect that request.

We may retain limited information on a suppression list to ensure that we do not inadvertently contact you again for marketing purposes. Keeping this limited record is preferable to deleting all information and potentially obtaining your details again from another source.

7. Sharing Personal Information

We may share personal information where necessary with organisations and individuals who assist us in operating our business or delivering our services.

These may include:

  • CRM and information technology providers
  • Website hosting and analytics providers
  • Communications and telecommunications providers
  • Professional advisers, including accountants, lawyers and compliance advisers
  • Sales and business development contractors
  • Other service providers acting on our behalf
  • Government bodies, regulators or law enforcement agencies where required by law

Where another organisation processes personal information on our behalf, we require appropriate contractual and organisational safeguards to protect that information.

We do not permit service providers acting on our behalf to use personal information for their own unrelated purposes.

8. International Transfers

Some of the service providers and contractors we use may be located outside the United Kingdom.

In particular, Markalation may use sales and business development contractors located in South Africa, who may have controlled remote access to relevant business contact information held within our systems.

We recognise that our sales and business development contractors in South Africa are acting as data processors as defined by the Regulations and, accordingly, they will be working within a controller-processor contract which they will sign as part of their Agreement with us. The controller-processor contract is available to view upon written application to privacy@markalation.com.

Where personal information is transferred to, or made accessible from, any country that is not covered by UK adequacy regulations, we put appropriate safeguards in place as required by UK data protection law.

These may include an appropriate UK international data transfer mechanism, together with an assessment of the circumstances and risks associated with the transfer and appropriate technical and organisational safeguards.

Access to personal information is limited to information reasonably required for the relevant individual’s role.

You may contact us if you would like further information about the safeguards applying to international transfers of your personal information.

9. Data Security

We use appropriate technical and organisational measures designed to protect personal information against unauthorised or unlawful processing, accidental loss, destruction, alteration or disclosure.

Depending upon the system and nature of the information, these measures may include:

  • Access controls based upon business need
  • Individual user accounts
  • Multi-factor authentication
  • Secure cloud-based systems
  • Restrictions on access to and use of personal information
  • Appropriate contractual obligations for contractors and service providers
  • Staff and contractor data protection requirements
  • Procedures for managing data incidents and breaches

No system can provide absolute security, but we regularly consider the measures appropriate to the nature and risks of the information we process.

10. How Long We Keep Personal Information

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet applicable legal, regulatory and business requirements.

The period will depend upon the type of information and our relationship with you.

For example:

  • Client and contractual information may be retained for the period necessary to manage the relationship and meet subsequent legal, taxation and accounting obligations.
  • Prospect and business development information will be periodically reviewed and deleted or anonymised when it is no longer reasonably required.
  • Marketing suppression records may be retained for longer where necessary to ensure that an individual’s objection to marketing continues to be respected.
  • Information required for legal or regulatory purposes may be retained for the applicable statutory period.

We periodically review the personal information we hold and securely delete or anonymise information that is no longer required.

11. Your Data Protection Rights

Depending upon the circumstances, you may have the right to:

  • Access personal information we hold about you
  • Correct inaccurate or incomplete information
  • Request deletion of your personal information in certain circumstances
  • Restrict processing in certain circumstances
  • Object to processing based upon legitimate interests
  • Object at any time to processing for direct marketing
  • Request data portability where applicable
  • Withdraw consent where processing is based upon consent
  • Ask about the source of personal information we obtained about you

These rights are not absolute and may depend upon the circumstances and lawful basis for processing.

To exercise your rights, contact:

privacy@markalation.com

We may need to verify your identity before responding to a request.

12. Automated Decision-Making and Profiling

We may use business information to identify and prioritise organisations or professional contacts that may be relevant to particular services or business development activity.

We do not currently make decisions about individuals based solely on automated processing that produce legal effects or similarly significant effects upon them.

If this changes, we will update this Privacy Notice and provide the information required by law.

13. Cookies and Website Analytics

Our website may use cookies and similar technologies to operate effectively and understand how visitors use the site.

Where cookies or similar technologies require consent, we will request that consent before using them.

You can manage your preferences through the cookie controls provided on our website and, where appropriate, through your browser settings.
